Realignment - Baylor stands in way

    A threat of legal action by Baylor has, at least temporarily, held up Texas AM's Big 12 counterparts waiving their right to a legal challenge.

  • Anyone else feel like Baylor is the submarine Dallas from The Hunt for Red October and they just jumped in front of the torpedo and are now going to aim right back at the Russians (A&M)?

    A&M and Slive shouldn't have been so cavalier about the negotiations early on.

  • What are the chances that Baylor's possible legal action could stop the ags from leaving?

    Honestly, I just want all this crap to end so we can focus on football. Whatever is going to happen needs to just go ahead and happen. I'm sick of realignment talk but its obviously gonna be around for awhile longer.

  • I understand that Baylor is upset because once atm leaves it seems like only a matter of time before the Big 12 is dissolved. Maybe the Big 12 replaces teams who leave with other teams but the conference will lose its AQ status as soon as it could more than likely. However, Baylor is only in the Big 12 because of political influence when the SWC broke up and the Big 12 was formed, so they should be a little more grateful of the time they had in a big boy conference. Its hard to think this whole realignment thing is going away this time like it did last year.

    Here's how Baylor is in a unique position.

    They are a private institution. As such, they don't have to answer to anyone as it relates to lawsuits.

    If Texas Tech or Kansas or Missouri were to stand in the way of A&M leaving, then their state governments could say by taking that stance you are putting the taxpayer at risk for potential damages (which would be alleged by A&M by not letting them go).

    As a private institution, Baylor doesn't have to answer up to the taxpayer in that same way. They are uniquely positioned to weather such a storm.

    I do not think it will stop them from leaving. It will possibly delay it, but most of all, likely get Baylor a little cash.

    I agree totally. And their admin and others with influence have a duty to the school, alumni, athletes, etc to do what it can to improve their situation.

  • Curious to know what exactly a Baylor suit will actually hope to achieve. I don't think they can block A&M from leaving based upon the language of the bylaws (there are reports of a new contract being signed last summer, but I don't think anyone has seen it causing me to doubt its existence), and they aren't going to get any money from A&M due to sovereign immunity. I do wonder if they would also threaten to go after the SEC in some manner for tortious interference given Slive's earlier comments before he backed off last month.

  • It seems the best think that can happen for Texas is if Baylor mucks this thing up in the courts for a couple of years and keeps the conference together long enough for Texas to position itself for the impending change. It would keep OU from forcing thier hand and give the LHN a couple of years to grow and become prosperous putting UT in a much better bargaining position.

    I'm being a little facetious obviously, but I am not a fan of negative action and litigation. Its like suing your ex to stay married? Keeping the Big 12 alive by lawsuit is negative action.

    Clearly they have a right, but the Big 12 is poisoned at this point and people need to find positive solutions and get clear resolutions, not tie things up with lawsuits and temper tantrums.

    Just my 2¢.

  • Don't see how this would stop ou from doing anything. Sounds to me like if ou is willing to take OSU (and Pac will accept them), they can go anytime they want.
