    And in America companies are free to set standards for choosing their employees so long as race, gender and creed are not factors (gender being excepted where appropriate, as here). Yours is a very shallow argument.

    Age discrimination is also illegal, but currently, only workers 40 and over are protected. I believe that adults who are under 40 should also have protection against age discrimination.

    Current law (under the ADEA) also allows for companies to favor older workers over younger. The "this is America" argument makes little sense when our tradition and law in this area is, even by your own admission, contrary to your position.

  • I would favor the NBA adopting the MLB model. You can enter the NBA draft after HS if you wish but if you enroll in college it is at least for 3 years. That puts the student back into student athlete as opposed to the sham that is currently being perpetrated on campuses across the country. It also allows the Kevin Durant and Lebron James types to go straight into the NBA as well as allowing those kids who aren't good enough out of HS to mature and work towards a degree.

    That type of system will lead to better decision making by the players, NBA teams and universities.

    I am arguing that our current law is at odds with the principles under which this country was established. Laws can be changed. Why should talented basketball players be forced to work for a university for no pay for a year when they could be making money in the NBA?

  • I actually read an article about thirty minutes ago that this would not be decided for another week. I know that for this year it was going to stay the same. Could the person who posted this show us where he read this? Maybe what I read was written before what he read.

    what "current law" is that, Mr. Barrister? you are actually talking about a collective bargaining agreement that the players support.

    The current law is the Age Discrimination in Employment Act referred to above. And of course the players support the collective bargaining agreement...less competition from 18-year-olds for them.

    I agree with this 100%...

    HS players are bound to a college contract (LOI) that they cant break but the colleges can (over-signing) and again with the student aid contract (athletic schollie). The MLB model would lessen the reality that NBA is using their monopoly status for better evaluations of players (and the fact that they dont trust themselves or each other to overpay a HS player) in better competition (college). At this point, elite players have no choice but to enter into very one sided college contract with no real desire to be a "student-athlete" or they would stay for more than a year or two.

    They don't have to work for a U for a year. There are other pro leagues, and there are other professions/jobs.

    You can't be elected to certain offices until a certain age (30 for U.S. Senate, 35 for POTUS, for example). Your idea that ageism against the young in employment is against our history and tradition is simply wrong. It's explicitly stated in our most precious document.

    Not real fair to say, "hey, you're not allowed to do this $1M job, but you can do this $50k job," IMO.

    Touche on the age requirements for certain elected offices, but it's a bit of a stretch to compare the President and Congress to basketball players. And I'd note that our most precious document also considered a black person in the South as three-fifths of a person; it's precious, but not perfect.

    I still haven't heard a good reason why an employer like the NBA should be able to deny jobs to qualified adults on the basis of their age.

    Agreed, age shouldn't matter after 18. But, like many jobs, a degree from a four-year college should be required.

    Whoa sorry I didn't catch that. Here is what I have learned; it is correct that the rule is going to stay the same. However, they are trying to come to an agreement on modifying the rule. If you commit to a school out of high school you have to stay two years or if you stay in school more then a couple of years you can benefit more financially on your first contract then if you went straight to the NBA out of high school or went one and done. There are a few more things they are thinking about as well. So the rule has not changed but it is possible it could. If they come up with some other solution that both sides can agree on during this contract.
